Dating Service Consumer Bill of Rights

This notice applies to paid Pair services that qualify as a social referral or online dating service. It supplements the Terms of Service and does not limit any stronger right you have under state or federal law.

Which state’s rules apply to you

A number of states regulate dating and social referral services and give customers specific rights — California, Connecticut, Illinois, Maryland, Michigan, Minnesota, Missouri, New York, North Carolina, Ohio, and Texas, among others. The details differ from state to state.

Rather than ask you to work out which rules apply, Pair grants the protections on this page to everyone: the three-business-day cancellation right, the ability to place a paid membership on hold, and deletion of your personal materials on request. If the state where you live gives you a stronger right than anything described here, that stronger right applies and we will honour it. Nothing on this page or in our Terms waives a consumer protection that cannot be waived.

Rights every Pair customer has

1. Cancel within three business days of purchasing a paid dating-service contract, without a cancellation fee, using the notice procedure below.
2. Cancel future renewals at any time from your App Store subscription settings or your Pair account screen. Subscriptions renew automatically until you cancel.
3. Place a paid membership on hold for up to one year by written notice.
4. Request deletion of your personal or private materials at expiry or termination, and a certification of deletion, except where the law requires us to retain something.
5. Not be required to buy anything else as a condition of the dating service.

Notice of cancellation

To cancel within the three-business-day period, email a signed and dated notice to hello@datewise.io with the subject NOTICE OF CANCELLATION. Include your full name, Pair account email, transaction date, the plan you purchased, today’s date, and this statement: “I cancel my Pair dating-service contract.” Typing your full legal name at the end serves as your electronic signature. We will return payments covered by this right within ten business days after receiving a valid notice.

You can also cancel future automatic renewals online from Pair’s Account screen. Cancellation does not remove rights that already accrued.

Additional New York rights

New York’s social referral service law sets out the following in more detail. These are in addition to the rights above.

1. A social referral service contract may not require more than $1,000 in payment or extend longer than two years, subject to the statutory online-dating exceptions for contracts and renewals of one year or less.
2. Pair may offer related optional services, but cannot require you to buy an ancillary good or service as a condition of the dating service contract.
3. For contracts over $25, if an online dating service with search, algorithmic, or location-based matching provides no social referral for two successive months, you may have a statutory cancellation and refund right, less the cancellation fee allowed by law. Contact us so the facts can be reviewed.
4. Pair is generally available on a regional, national, or global basis, so the contract does not set a single mandatory travel distance. You control your own distance preference and may change it in Preferences.
5. You may place a paid social-referral membership on hold for up to one year by written notice. Email hello@datewise.io with your account email and requested start date. We will confirm the billing and access effect in writing before the hold begins.
6. At expiration or termination, you may request that personal or private materials be deleted and that we provide a certification of deletion, except for material we must retain by law or court order.
7. If a provider violates a social referral service contract, you may have the right to bring a court action. Nothing in our Terms waives a non-waivable consumer remedy.

Moving or changing your service area

Pair is offered online across broad service areas. If you move, update your location and distance preferences. If the move makes a paid service materially unavailable, contact us; we will review a transfer, hold, cancellation, or prorated remedy required by applicable law.
